These Terms of Service ("Terms") govern your ("Client", "you", "your") access to and use of the AI chat widget services ("Services") provided by Chatgo AI ("Company", "we", "us", "our"), a business based in New Zealand. By using our Services, you agree to be bound by these Terms.
2. Our Services
Chatgo AI provides an AI-powered chat widget that businesses can install on their website. The widget assists visitors by answering questions and booking appointments. The specific features are outlined on our website and in the onboarding documentation we provide to you.
3. Fees and Payment
- Pricing: Our fees are as quoted on our website or in a separate written proposal. All fees are in New Zealand Dollars (NZD) and exclude GST unless stated otherwise.
- Payment: You agree to pay all fees on time as specified. We will bill you on a recurring monthly basis, starting from the date we confirm your account is active.
- Price Changes: We may change our fees with 30 days' written notice. Any changes will not apply to the current billing cycle for which you have already paid.
4. Cancellation and Refunds (Non-Refundable Subscriptions)

- How to Cancel: You may cancel your monthly subscription at any time by providing written notice via email to [email protected].
- No Refunds for Partial Months: Your monthly subscription fee is for a full month of service and is non-refundable. If you cancel your subscription after your current billing period has started, you will not receive a refund for the remaining days in that month.
- Access After Cancellation: After you cancel, your Chatgo AI widget will remain active and available on your website until the end of your current paid billing period. You will have full access to the service for the remainder of that month.
- No Further Charges: Once you cancel, you will not be billed for any future months. Your payment method will not be charged again after your current term ends.
5. Consumer Guarantees Act (CGA)
This section is important for providing context and protecting your business.
- Business Customers: If you are using our Services for the purposes of your business, you agree that the New Zealand Consumer Guarantees Act does not apply.
- Consumer Rights: If you are an individual consumer using our Services primarily for personal, domestic, or household use, the Consumer Guarantees Act may apply, meaning you have certain rights that cannot be contracted out of. These rights are separate from our standard "no refunds" policy.
6. Your Responsibilities
- You are responsible for providing accurate information to us and for maintaining the security of any login details for your Chatgo AI account.
- You agree to use our Services in compliance with all applicable New Zealand laws and regulations.
- You are responsible for ensuring that your own business or website's privacy policy is compliant and that you have the necessary consents to use our AI widget.
7. Limitation of Liability
To the maximum extent permitted by New Zealand law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
- Our total liability to you for any claim is capped at the total fees paid by you to us in the three months preceding the claim.
8. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to you by email. Continued use of the Services after the effective date of any changes constitutes your acceptance of the new Terms.
9. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
